I decided to send the members of NAR's (National Association of Realtors) MLS committee a e-mail to see what sort of response I would get from them.
What follows will be a little he said she said, but anyway here it is.
Dear NAR MLS Committee Member (I used his/her name)
I just wanted to pop you a e-mail asking you to keep the MLS Free. There has been a discussion about NAR’s efforts to stop Realtors use of the term MLS on their websites and such. http://www.realestatewebmasters.com/thread20099.html I hope you understand that stopping Realtors from using the term only gives the term totally over to companies such as homegain, homes.com, housevalues.com, Zillow, Trulia… who will then use the term in their online marketing to gather home buyer and seller leads which they will seek to sell to Realtors who cannot use the MLS term. Seems totally crazy for NAR to punish Realtors for using the term when NAR has no ability to stop non Realtors from using it.

The MLS is NOT free now and we should keep it that way… Realtors are misusing the term due to the fact that an IDX feed is NOT the MLS, so all who have “Search the MLS” on their website are in violation of the code of ethics (true picture in advertising).. Further, the more we use the term MLS (which we cannot trademark, like Realtor) in the public domain, the more we open ourselves to the government declaring it a public utility and potentially devaluing our services as Realtors…
I thought to my self, hmmm I am not really convinced so I said:
Hi NAR MLS Committee Member,
Thank you for reading the e-mail I sent to you and responding. It is good to see that the members of the MLS committee are reachable.
I understand what the committee is trying to do, but can you stop Trulia, Realtor.com, homegain, housevalues, homes.com, … from using the term Search the MLS??? I think the answer to that is no. I think that if NAR tries to stop them from using it the DOJ (Department of Justice) will have yet another arrow with which to shoot at NAR and actually may claim restraint of trade for trying to keep Realtors from using the Search the MLS term.
Non Real Estate professionals who are looking for homes and using the search engines will search terms such as County MLS, or State MLS all the time. Restrict Realtors from using the term MLS and where do these consumers end up?? Homegain, Housevalues, … Then these companies want to sell these leads back to us the Realtors. So not only to we have to pay NAR to not be able to use Search the MLS, then if we want any of the leads from these many people who search in the search engines (something MLS) we have to pay these other companies, So we pay NAR to cost us more money.
I can tell your mind is made up but please look at this from the other side of the coin, MLS is already a generic term (not trademark able).

Just give this a thought… If every Realtor in the country stopped using the term “MLS” and started using a new trademarked term that other entities couldn’t use, would that help?
Now how likely is it that the public is going to stop using the term MLS when they talk about their house being listed for sale by a Realtor, or when they go to a search engine to start looking for homes. To me this just means like Ryan Ward says, we as REALTORS will be forced to surrender the search term to the Internet lead sellers. To this I scream NO NO NO.
Currently I am not using the term Search The MLS on my website, but I should be.

I agree with you Ryan. I sent one more e-mail to the guy and included with what I send here is what I got back. Hi NAR MLS Committee Member, I am interested in knowing just how someone gets on a committee like this. I have been a REALTOR® for 4 years now and not once have I ever been asked to vote or approve anything. I hear what you were saying but think that it is totally the wrong approach. Here is a excerpt from the conversation about NAR’s move to make using the term MLS a violation. “It's nothing short of irresponsible, anti-competitive and due to this decision, consumers will be even more misrepresented by the use of the term. In their efforts to protect the consumer, they are doing far more harm than good. I have the MLS feed in my website. Non members have elective listings as advertising and will portray it to the consumer as the MLS. What's worse?” I agree with many of the above thoughts. The consumer is not going to stop using the term “MLS” no matter what NAR thinks or does. Once the few of us who use MLS or Search the MLS on our websites are forced to stop using it, the lead sellers (homegain, housevalues, homes, …) will be free to have a monopoly on advertising the terms associated with MLS and then be able to extort a 30% or 35% referral fee from Realtors for even more consumers who end up in their clutches. I was a board President which led me to be a NAR director, which in turn enabled me to get appointed to the MLS committee at NAR. So get involved locally… Regards, NAR MLS Board Member I don't know about your local board of realtors Ryan, but there does not seem to be much reason to get involved in mine.

Hi Jim, Great post. I don't get the arrogance from these people. How on earth are they going to rename the MLS? Once they rename it and inform the American public will we be able to use it or will they say we can't use it because we don't show all of the information in it? Sorry, but, that is absurd, costly, narrow minded and, well, just ignorant. These people are trying to play a game of semantics and it's very unbecoming. I just love when they say that consumers are not using the MLS on my website. Do they take me for an idiot? Let's see...The MLS data feed is provided to my vendor of choice, REW. I integrate the MLS datafeed onto my website for consumers to search all active listings in the MLS database. Some knucklehead wants to come and tell me that this is not the MLS? Sorry, that doesn't fly and, in my opinion is blatantly dishonest. A true picture of MLS does not require that all data be shown. To make their argument, that's what you have to do.
