California DRE License Number now Mandatory
Posted Jul 14, 2009 @ 5:23 pm, Viewed by 662 Visitors, Read 702 Times.As of July 1st real estate agents in California now must have their license number on solicitation materials that are considered a point of first contact with consumers. Most of the discussion that I have seen at my brokerage has talked about the need for updated business cards with the license number added, but I just ran across a memo produced by the California Association of Realtors that also includes the need for the license number to be included on websites.
I had asked several staff people with my local MLS if websites like my Sacramento site were considered first point of contact - they felt they were not. In their opinion, first point of contact would be an email to a consumer - so I did not fully prepare for this change. Well with the CAR legal clarification and the fact that it is now the middle of July I need to get busy to get my online marketing materials in compliance with this new regulation. Most Calfornia agents have probably heard this information many times, but now would be a good time to double check for compliance. I'm realizing I have quite a bit of work to do make sure materials that are "intended to induce a consumer to contact the licensee [me] about any licensed services" have my license number somewhere on them. The reason behind the first point of contact license requirement is that with common names it can sometimes be difficult for consumers to properly identify the correct licensee. Since my name is fairly uncommon not really something the DRE has to worry about with me.
FYI my license # is 0115440 and I will be updating the about section of this blog in just a couple of minutes.

Whether we like it or not, in California, it is now mandated by the DRE. It's no big deal to do it.
A quick recap ..The new section 2773 regulation requires license ID number on:
>Business cards
>Stationary
>Websites owned, controlled and/or maintained by the soliciting real estate license
>Promotional and ad flyers, brochures, email, regular email, leaflets, and any other marketing material designed to solicit the creation of a relationship of the consumer.
So much for stealth sites... will be interesting to see if most agents adhere to the rule.

I do not see the need for a license # to be posted on marketing material. what if an office assistant is drafting the material? What does it matter anyways? Real Estate in Manitowoc WI there is no need for any such law. As a matter of fact we are one of only a few counties remaining with a flat 5% sales tax.
